Student Organization Program Official Rules

The sponsor of this promotion is MyEdu Corporation, located at 1301 S. Mopac Expwy Ste. 250, Austin, TX 78746 ("Sponsor"). These terms and conditions are an agreement between you and the MyEdu Corporation.

Registration

MyEdu allows you to register online for the Program and earn money by promoting certain MyEdu products and services using approved promotional methods in accordance with this Agreement.

Organizations. This Program is restricted to on-campus student organizations ("Organizations") that are officially sanctioned by their university, college, or high school and their student representatives.
Registration. To participate in the Program, you must submit a complete application using the online registration tools. You may not submit an application if you, your Organization, or your respective MyEdu accounts have been terminated at an earlier point in time. You are not allowed to register as a representative of more than one Organization at a time. You must be 18 years of age or older, and a resident of the 50 United States or District of Columbia, to participate. You must be a registered student or student organization advisor at the time of participation in the Program.
Accurate Information. You agree to provide MyEdu with complete and accurate information about you and if requested your Promotional Methods, and to maintain up-to-date account information. MyEdu has the right to confirm or otherwise verify or check, in its sole discretion, the truth and accuracy of any registration information at any time, and void any account without payment if MyEdu finds that such information is false, or that you are using, registering or controlling multiple accounts.
Account Security. You will be responsible for all activity on your account and for loss, theft or unauthorized disclosure of your password (other than through MyEdu's gross negligence or willful misconduct or omission). You shall provide us with prompt written notification of any known or suspected unauthorized use of your account or breach of the security of your account.
Your Relationship with MyEdu. Nothing in this agreement establishes an employment relationship. You may not in any manner misrepresent or embellish your relationship with MyEdu. You work independently as much or as little as you wish, on your own schedule, using your own computer or other tools, and paying your own expenses. Any help or suggestions that you may receive from MyEdu or others are simply suggestions, as MyEdu in no way controls or directs your activities.

Terms

Program duration. The promotional Program will run between December 16th, 2011 and March 16th, 2012. The duration of the Program may be shortened or extended without prior notification.
Issuance of Promotion Codes. Once accepted into the Program, Participants will be provided with a unique Promotion Code ("Code") which they may share with potential MyEdu users who reside in the United States under the conditions set out in this Program.
Referral Bonus for New Users. For each verified New User that a participating Organization or representative registers for a new MyEdu account, the Organization will earn $1. Participants will only qualify for payment disbursements once they have accrued $20 worth of referral bonuses and for every $20 thereafter. Payment of referral bonuses of less than $20 or between multiples of $20 is at MyEdu's discretion, and Participants agree to forfeit these bonuses (not to exceed $19.99).
Restrictions on New Users. A "New User" is defined as a registered college student or active high school student who is not a current MyEdu account holder and has not been a MyEdu subscriber in the past 6 months. A New User must access MyEdu's site via a link embedded with the Participant's unique Code, completely fill out MyEdu's online registration forms, and either: 1. register or connect their Facebook account; or 2. confirm his or her email account via a link that will be sent to the email address provided during registration in order to qualify. New Users do not have to be Organization members to qualify.
Payment schedule. Referral payments will be made on a net quarterly cycle following the termination of the Program. If the Program is extended, bonus payments will be made on a net quarterly cycle following the accrual of $20 of referral bonuses through New User registrations. Payments will be delivered via mail approximately 4 - 6 weeks thereafter. Participants are responsible for ensuring that their mailing address in our records is up to date and accurate. Return of any referral bonus as undeliverable or incomplete or incorrect email or mailing address submission will result in forfeiture of the bonus. MyEdu may change the timing and mechanics of its payment schedule at any time by providing notice to Participants of the change.
Prohibited Methods. This Program is designed to compensate you for good faith efforts to market MyEdu's services to other legitimate customers. You will not be compensated for transactions where you or your agent are the customer, or where you engaged in activity that is in breach of this agreement. You agree that you will not engage in tactics or receive compensation for efforts to game the system, create multiple accounts or do business with customers who engage in multiple accounts or identities, or collude with others to, in any way, obtain payments inconsistent with the purpose of the Program.
Program Amendments. MyEdu can make adjustments to the bonus payout structure at any time by updating the MyEdu Referral Bonus terms. No prior notification is necessary before amendments take effect. You may, at any time, end your participation in the program by giving MyEdu notice of your withdrawal from the program. MyEdu may suspend or cancel this Program at any time by announcement on this Site.
Taxes. By law, all Participants are required to complete and submit a W-9 Form to MyEdu. MyEdu is also required to file Form 1099 with the Internal Revenue Service for organizations earning $600 or more. Participants agree that they are responsible for complying with this law, and MyEdu may withhold payments to participants whose annual earnings exceed $600 until such paperwork has been completed and filed with MyEdu.
Miscellaneous. By participating, Participants agree to the terms delineated herein & as applicable, & further agree that: 1) MyEdu shall have no liability & will be held harmless by for any claim, action, liability, loss, injury or damage to Participants, the Organization they represent, or any other person or entity, including, without limitation, personal injury or death to Participants or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of participation in this Offer; & 2) Use of a Code to make a qualifying order constitutes consent to participate in this Offer & to be bound by Offer Terms & Conditions. Further, MyEdu is not responsible for any late, lost, misdirected, delayed, or undelivered Codes, Referral bonuses or Offer Discounts; any error, omission, interruption, defect or delay in transmission, order processing, or communication; telephonic, human or computer failures, problems or errors; technical or mechanical malfunctions; failures or malfunctions of phones, phone lines, telephone systems, or other equipment; errors in Terms & Conditions, in any Offer-related materials; human-processing error; failures of electronic equipment, computer hardware or software; or inaccurate information, whether caused by equipment, Offer programming, human error, or otherwise. All federal, state & local taxes, if any, are the sole responsibility of recipient. May not be combined with any other offer, discount or coupon.

Your Conduct

In your efforts to promote MyEdu to potential customers, your activities are governed by a number of state and federal laws designed to protect consumers, as well as terms and conditions of other websites that may govern your conduct on those sites. You are expected to be familiar with these laws, and abide by them. Your conduct may also be rules published by your school limiting commercial marketing activity that can be on campus; you should respect those rules. Further, MyEdu has created a series of guidelines to encourage responsible and ethical marketing behavior among Participants; you are required to abide by this Code of Conduct as well. Where MyEdu becomes aware that a Participant is engaged in activity that may violate the Code of Conduct or any applicable state or federal law, school rules, or the terms of use of any website that the Participant has used to promote MyEdu, MyEdu will review the facts and circumstances of the violation and may, in its sole discretion, warn or suspend the Participant from the Program.

Release

If you have a dispute with a customer, other Participants, schools or other venues, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes. If you are a California resident, you waive California Civil Code §1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."

Privacy

We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We use your information only as described in the Participants Privacy Policy. We view protection of Participants' privacy as a very important community principle. We store and process your information on computers located in the United States that are protected by physical as well as technological security devices. You can access and modify the information you provide us and choose not to receive certain communications by signing-in to your account. If you object to your information being transferred or used in this way please do not participate in this Program.

Indemnity

You will indemnify and hold us (and our officers, directors, agents, subsidiaries, joint ventures and employees) harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party.

No Agency

No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.

Notices

Except as explicitly stated otherwise, legal notices shall be served on MyEdu at our headquarters in Austin, TX, or to the email address you provide to MyEdu during the registration process (in your case). Notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Alternatively, we may give you legal notice by mail to the address provided during the registration process. In such case, notice shall be deemed given three days after the date of mailing.

General

MyEdu is located at 1301 S. Mopac Expwy Ste. 250, Austin, TX 78746. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. In our sole discretion, we may assign this Agreement in accordance with the Notices Section. Headings are for reference purposes only and do not limit the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. We do not guarantee we will take action against all breaches of this Agreement.
We may amend this Agreement at any time by posting the amended terms on this site. Except as stated elsewhere, all amended terms shall automatically be effective immediately after they are initially posted. Additionally, we will notify you through your registered email address.
This Agreement sets forth the entire understanding and agreement between us with respect to the Program.
